The Failure of the 28-Clause Ceasefire Plan for Ukraine: How Peace Negotiations Continue to Falter

Europe experienced widespread relief on Monday, as the diplomatic emergency triggered by the presentation of a new 28-point plan for achieving ceasefire appeared – temporarily – to have been contained. A Washington representative spoke of "substantial progress" after Ukraine-US talks in Geneva. On Monday night, Moscow made its countermove: a renewed assault of aerial bombardment on Kyiv.

The Rhythm of Peace Talks and Military Action

The sequence of opposing developments captured the bleak nature of the recent timeframe. By day, political struggles are fought: optimistic declarations are delivered from multiple capitals. Immense energy is allocated on restraining particular approaches. By night, Moscow forcefully demonstrates the world that, for them, military action persists as the key method for achieving "settlement".

Nocturnal Warfare

As the offensive progressed into the early hours of Tuesday, the immediate reality of Ukraine's vulnerability was revealed. Ukraine is equipped to monitor rocket firings from across the border, a capability provided through timely intelligence. From observation points, military aircraft that had been dispatched to engage hostile cruise missiles roared overhead – advanced fighter aircraft supplied to Ukraine by NATO members.

Soon thereafter, Kyiv's anti-aircraft weapons engaged: multiple launches targeted at a Russian ballistic missile. This was a sophisticated defense system at work, presumably provided by partner states. Every launch shakes the surroundings, causing tremors. The instant of fear quickly becomes grim resignation: perhaps the approaching threat won't cause damage this time, sparing the city from ruin and another blackout.

Ongoing Risks

Following this, a automatic firearm opened up on a drone close by, part of a mobile-fire group – almost certainly imported technology. Unfortunately, the projectiles didn't strike the hostile drone – it continued its flight toward its target.

Periodically, this continued until dawn. Kyiv faced the daybreak reports: multiple fatalities, damage and heating outages in multiple buildings as a result of the nocturnal offensive. As customarily, everyone still maintained normal activities – experiencing conflict. But those full day demonstrated Ukraine's vital need on international aid – a need that regional partners are clearly incapable to fill in the immediate future.

Ineffective Peace Efforts

The 28-point plan from US administration provoked deep reactions, debate and deep concern – and briefly redirected concern from Ukraine's most significant graft case in years. Yet, we have experienced comparable situations, after previous diplomatic encounters and international summits.

Every new proposal from American administration follows the identical sequence: a diplomatic cavalry charge against Ukraine, which Kyiv, with other European capitals, manages to fend off. They contain the crisis but never actually win the battle. This cycle will, undoubtedly, endure.

Strategic Calculations

It is convenient to criticize certain parties of persistently promoting Kremlin's demands. But that does not seem to be the entire situation. Washington works based on a principle understood by seasoned negotiators: you cannot win at the negotiating table what you have been unable to protect through force. The White House assumes that it is unrealistic to force Russia to abandon the land that it already controls in Ukraine's southern or eastern regions.

The challenge is that while recognising this factual reality, American administration does little to discourage Russia, through words or deeds, from assuming that the status quo will not shift further in its advantage in the coming year.

Divergent Views

Therefore, the Kremlin is convinced that duration works to their advantage – that Ukraine and its supporters are coming close to fatigue. Their motivation to agree to terms that does not give them the maximum possible gain is almost completely absent. There may be multiple initiatives to end hostilities, but they will carry on as long as Russia's leadership remains completely certain in the conclusion.

On the contrary, Ukraine's government believes that Ukraine can still persist, progressively conceding civilians and areas but avoiding a entire defensive failure until conditions improve in its favour.

Present Conditions

Objectively, there are no actual prerequisites for a truce. Now, individual motivations are becoming relevant: personal goals to broker a ceasefire and secure international recognition, and the government's double obstacles – on one hand, not to alienate a key ally, and on the other, to rally Ukrainians around the flag against any proposal Kyiv finds unworkable, so that their focus does not switch to homefront challenges. And although their task will now be much harder after latest incidents, it remains highly unlikely that this will change their overall approach.

These conflicting dynamics are driving the talks.

Conclusion and Outlook

It took a mere seven days to terminate the proposed articles of the latest plan. Aggressive and erratic handling of the matter by American leadership, pushback by Ukraine and the remaining European nations, along with soothing efforts of diplomats, and finally, recent disclosures, all achieved their purpose.

While new initiatives based on previous concepts are forthcoming, Kyiv, London and other Western governments should arrive at a critical understanding: Ukraine and Europe will only be able to resist political attacks from Washington that are based on Russian demands and demonstrate certain reluctance to modify developments, if they maintain solidarity and improve their protective measures at a significantly accelerated rate. If they do, no combination of diplomatic or military actions will be able to break them. In the meantime, Ukraine's ability to counter nocturnal attacks will, for the predictable period, largely rely on continued Western support.
